Welcome to Avaway ("we", "our", or "the App").
These Terms and Conditions ("Terms") govern your access to and use of the Avaway mobile application and related services.
By downloading, accessing, or using Avaway, you agree to comply with and be bound by these Terms.
If you do not agree, please do not use the App.
Avaway is a ride-hailing platform that connects passengers ("Users" or "Riders") with independent drivers ("Drivers") for transportation services.
Avaway itself does not own or operate vehicles, and all rides are provided by independent third-party drivers.
By using Avaway, you confirm that:
You are at least 18 years old.
You have full legal capacity to enter into this agreement.
You will provide accurate and complete information during registration.
To use Avaway, you must create an account by providing personal information such as your name, phone number, and email.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Avaway reserves the right to suspend or terminate any account found to be providing false or misleading information.
When using Avaway, you agree to:
Use the service only for lawful purposes.
Not misuse or disrupt the service.
Treat other users and drivers with respect.
Not use the service for illegal transportation, fraud, or harassment.
We reserve the right to block, suspend, or permanently ban users who violate these terms or misuse the platform.
Trip fares are calculated based on factors such as distance, time, and demand.
You agree to pay the full fare displayed at the end of your trip.
Payment methods may include cash, wallet balance, or other payment options supported by Avaway.
Avaway reserves the right to update or modify fare rates at any time.
You may cancel a ride request before a driver accepts it without any charge.
If you cancel after a driver has already accepted or reached your pickup location, you may be charged a cancellation fee.
Repeated cancellations may result in temporary suspension of your account.
Drivers using Avaway agree to:
Hold a valid driver’s license and vehicle registration.
Maintain vehicle safety and cleanliness.
Comply with all local traffic laws and regulations.
Not share their driver account with others.
Drivers are independent contractors, not employees or representatives of Avaway.
Avaway acts solely as a technology platform connecting riders and drivers.
We are not responsible for:
The actions, behavior, or conduct of any driver or passenger.
Loss, theft, or damage during the ride.
Delays, cancellations, or service interruptions caused by external factors.
By using Avaway, you agree that the company is not liable for any direct or indirect damages resulting from the use of the service.
Riders must verify vehicle and driver details before starting a trip.
Drivers and riders must adhere to all safety guidelines provided within the app.
Avaway encourages users to report any suspicious or unsafe activity immediately.

We may suspend or terminate your access to the Avaway app at any time, with or without notice, if you:
Violate these Terms
Misuse the service
Engage in fraudulent or unlawful activities
Upon termination, all rights granted to you under these Terms will immediately cease.
Avaway reserves the right to modify or update these Terms at any time.
Any significant changes will be communicated through the app or via email.
Your continued use of the app after such updates means you accept the revised Terms.
These Terms are governed by the laws of Iraq.
Any disputes shall be resolved through the competent courts located in Erbil, Iraq.
